Read these terms and conditions carefully before making any reservation or purchase at Viaaza. These terms and conditions are used to clarify rights and responsibilities of clients, and the rights and responsibilities of Viaaza. When making a reservation or a purchase at Viaaza, you become a client and agree that you have read, understood and agree with these terms and conditions. Viaaza may update these terms and conditions from time to time. Material changes will be notified to clients with active bookings, who may terminate without penalty before such changes take effect. Bookings already confirmed and paid for are governed by the version of these terms in force at the time of booking. These terms and conditions are last updated on May 17th, 2026.

Article 1: Applicability of these terms and conditions

1.1 These terms and conditions are applicable to every offer, agreement between Viaaza and its clients.

1.2 These terms and conditions are applicable to all services, activities and products offered by Viaaza.

1.3 Applicability of terms and conditions of clients are not valid and are rejected.

1.4 By making use of offered services, activities or products, clients agree to these terms and conditions.

1.5 If a provision in a part of an article is void or annulled, then this shall not affect validity of other provisions of the article and other articles. The provision that is void or annulled shall be replaced with a provision that corresponds as closely as possible to the intention of both parties.

Article 2: Information and offers

2.1 All requests for information, offers, prices, plans, programs, specifications etcetera are free of cost. Clients have the right not to commit or not be obliged to commit to the offer. No costs are involved for the client, unless otherwise specifically communicated and agreed between both parties.

2.2 All information, offers, prices, plans, programs, specifications etcetera are always approximate, unless specifically stated otherwise in writing.

2.3 When an offer from Viaaza is not followed up by a written order or an e-mail within 14 calendar days written by the client, it shall lapse and is no longer valid.

2.4 All prices on the website are stated in United States Dollars (USD). When payment is made in another currency, conversion is performed by your payment provider at their prevailing rate; any conversion fees are charged by your payment provider and are not retained by Viaaza.

Article 3: Clients' responsibility

3.1 To participate in offered services and activities by Viaaza, you must be 18 years of age or older. If you are under 18 at the date of departure or first day of the activity, you need to be in constant companion by an adult like parent or legal supervisor.

3.2 Unless otherwise agreed in writing, the client shall ensure at its own expense that sufficient measures are taken to ensure safety during the service and activity of participation.

3.3 The client is obliged to inform Viaaza in a timely manner with all information that it knows or should have known is necessary for the execution of the service or activity via e-mail. The client is responsible to provide this information in completeness and correctness.

3.4 The client is responsible to cover all costs related to any unforeseen risks associated with participation in the service or activity. Viaaza recommends customers to purchase among others a travel insurance at your local insurance agency for complete coverage of unforeseen circumstances. Your travel insurance policy should cover among others cost related to cancellation fees, cost related to medical care / injury / death, cost related to theft / robbery, cost related to loss of private belongings and cost coming forth by force majeure.

3.5 The client is responsible for any damage caused by the client to goods and / or property from Viaaza and, third parties and partners.

3.6 The client is responsible to be present at the designated time and location.

Article 4: Clients' rights

4.1 The client has the right to ask for an update, more information, status of the purchased services, activities and / or services.

4.2 The client has the right to a full refund of the amounts paid when Viaaza confirms in advance that it is not able to deliver the purchased services, activities or products.

4.3 If Viaaza fails to deliver a purchased service, activity or product on the scheduled day for any reason other than the client's own non-attendance, the client is entitled — at the client's choice — to (a) a full refund of the amounts paid for the affected service, activity or product, or (b) a substitute service, activity or product of equal value at a mutually agreed time. This right is in addition to any further rights the client may have under the EU Package Travel Directive (2015/2302), the Dutch Civil Code (Burgerlijk Wetboek Book 7, Title 7A), or mandatory consumer-protection law of the client's home jurisdiction.

Article 5: Viaaza responsibility

5.1 It is our responsibility to inform you of all relevant information related to all our offered services, activities and products.

5.2 It is our responsibility to prepare, perform and / or deliver the service, activity and product as agreed with the client. For safety reasons, we reserve ourselves the right to alter, adjust, change and / or cancel schedule plans.

5.3 It is our responsibility to offer professional expertise on all offered services, activities and products. For example, historical facts during tours at historical locations.

5.4 It is our responsibility to provide at all times, upon first request of the client, information, status and confirmations of bought services, activities and / or products.

Article 6: Viaaza rights and liability

6.1 Viaaza reserves the right to engage third parties to fulfil the agreement between Viaaza and the client.

6.2 Subject to Article 6.7 below, Viaaza shall not be liable for damage arising from our reliance on incorrect or incomplete information provided by or on behalf of the client.

6.3 Subject to Article 6.7 below, Viaaza's total liability to the client under or in connection with the agreement is limited to the total price paid by the client for the affected service, activity or product.

6.4 Subject to Article 6.7 below, Viaaza is not liable for damage caused by shortcomings or unlawful acts of independent third parties, suppliers or partners involved in delivering the agreed service or activity, except where Viaaza is liable for such third-party performance as an organiser under the EU Package Travel Directive (2015/2302).

6.5 Any advice provided by Viaaza outside the scope of a booked service is given without obligation, and any follow-up is at the client's own expense and risk.

6.6 The client shall indemnify Viaaza against third-party claims arising from the client's own negligent or wrongful acts in connection with the service or activity. This clause does not require the client to indemnify Viaaza for any claim caused by Viaaza's own negligence, gross negligence or wilful misconduct.

6.7 Nothing in these terms and conditions excludes or limits Viaaza's liability for: (a) death or personal injury caused by Viaaza's negligence; (b) Viaaza's gross negligence or wilful misconduct; (c) any other liability that cannot be excluded or limited under mandatory applicable law, including the EU Package Travel Directive (2015/2302) and any mandatory consumer-protection law of the client's home jurisdiction.

Article 7: Ordering process

7.1 Purchasing services, activities and products from Viaaza is online at the website https://viaaza.com.

• You order and pay online.

• Money from online payments goes to the bank account of Viaaza.

• You will receive an email about order and payment confirmation within 24-48 hours.

• You will receive contact information of our support team, which can be used for questions, help or any personal need.

• Print or show the e-mail of the order payment confirmation to your guide at the beginning of your trip with Viaaza.

7.2 Cancellation, completely or partly of your purchased service, activity or product is possible, but a fee will be charged. File your cancellation request via email to [email protected]. The cancellation fees below are being applied to all our offered services, activities and products. Any investment as part of preparation to your trip with Viaaza, like hotel reservations, airplane tickets or any other type of investment, will be deducted from the refund. Costs related to execution of the refund payments are also deducted from the total refund value.

Cancellation fees (based on the number of days between the cancellation date and the date of departure or first day of your activity):

• 30 days or fewer before departure: 100% of the total price.

• 31 to 90 days before departure: 75% of the total price.

• 91 to 120 days before departure: 50% of the total price.

• 121 or more days before departure: 25% of the total price.

7.3 No partial or complete refund shall be provided when the purchased service or activity is unused. Unused includes situations where you are not present at the designated time and location as described to start the service or activity.

7.4 Request for change of the purchased services, activities and products of Viaaza is possible at the cost of a change fee. Change fees are related to any change of the purchased services, activities and products. For example, change of dates, location, travel activities etcetera. The change fee is based upon any cost related to realize the change and an administration fee. Additional costs are for example change of hotel bookings. The administration fee is 10% of the total purchase value.

7.5 In case of adding additional passengers to the purchased service or activity, only additional costs related to adding the extra person will be charged. Once an extra person is added and confirmed, the extra person cannot be removed or cancelled without a cancellation fee.

7.6 Viaaza may revoke a confirmed order only for specified reasons, namely: (a) safety or health risk to the client or to others; (b) force majeure as defined in Article 8; (c) inability of a third-party supplier to deliver and inability of Viaaza to arrange a substitute of equal value; or (d) the client's own breach of these terms and conditions. Where Viaaza revokes an order under (a), (b) or (c), the client is entitled to a full refund of the amounts paid or, at the client's choice, to a substitute service of equal value. Where Viaaza revokes under (d), refunds (if any) are governed by Article 7.2.

Article 8: Force majeure circumstances and liability

Any failure to deliver or perform, any delay, any liability, any damage from the side of Viaaza shall be excused and not be held responsible through consequences of disasters coming forth by nature, labour strikes, civil commotions, weather conditions, theft, war, terrorism, epidemic, travel ban, Acts of God and any other circumstance beyond the control of Viaaza.

Article 9: Passports and visa

You are always responsible to identify yourself with a passport that includes a valid visa. Check beforehand visa regulation for your country in relation to visiting Ecuador. Viaaza is not responsible for visa arrangements.

Article 10: Language

Our travel experts speak fluent English and Spanish. All services and activities are supported with both languages.

All our information, images, videos, logos, infographics are created and owned by Viaaza. Use without permission of our content is prohibited. The website https://viaaza.com and its content is owned by Viaaza.

Article 13: Governing law and jurisdiction

13.1 These terms and conditions, and any agreement between Viaaza and the client formed under them, are governed by the laws of the Netherlands.

13.2 For clients who are consumers habitually resident in the European Union or the European Economic Area, this choice of Dutch law does not deprive the client of the protection afforded by the mandatory provisions of the law of the consumer's country of habitual residence, in accordance with Article 6 of the Rome I Regulation (Regulation (EC) No 593/2008).

13.3 For clients who are consumers resident in the United States of America, this choice of Dutch law does not deprive the client of the protection afforded by the mandatory consumer-protection provisions of the law of the consumer's home state. US consumers retain the right to bring claims arising under such mandatory provisions in the competent court of their home state, including a small-claims court within that court's jurisdictional limit.

13.4 Subject to Articles 13.2 and 13.3, any dispute arising out of or in connection with these terms and conditions shall be submitted to the exclusive jurisdiction of the competent court in the Netherlands, with the district court of the place where Viaaza B.V. has its registered office (currently Leerdam) as the court of first instance.
